The Case
Neligan LLP represented the owners of a boutique, luxury lifestyle hotel located on Waikiki Beach in Honolulu, Hawaii, which sought protection in bankruptcy as a result of a dispute with the management company, Marriott, over $100 million in secured and unsecured debt, and the effects of the 2008 recession on the travel industry. Neligan LLP successfully and expeditiously guided the company through a hotly contested reorganization proceeding, which resulted in a settlement of Marriott’s disputed claim and confirmation of a reorganization plan that allowed the company to exit bankruptcy with a new management team of its choosing, payment of all general unsecured claims, and restructured and extended the company’s senior secured debt.
